1. Who these terms are between
These terms are an agreement between ConstructionWebDesign.uk ("we", "us") and you ("you", "client") — the person or company hiring us. By commissioning work, signing a proposal, or paying an invoice you agree to these terms.
Anything specific to your project (scope, timeline, price) lives in your proposal or statement of work. If a term in your proposal conflicts with these, the proposal wins.
2. The work
We design, build, and maintain websites for construction companies, contractors, and trades across the UK. The exact deliverables for your project will be in your proposal. We'll do the work to a professional standard, on time, and as agreed.
What we need from you
- Decisions and feedback within reasonable timeframes (5 working days unless agreed otherwise)
- Brand assets, photos, copy, and login details where relevant
- Approval of designs and content before launch
- Honesty about what's working and what isn't
If we're stuck waiting on you for more than 30 days, we may pause the project. Restarting after a long pause may carry a small re-onboarding fee.
3. Pricing & payment
Our packages are fixed price. The number on your proposal is the number you pay — no surprise invoices. Anything outside the agreed scope is quoted separately before any work starts.
- 50% deposit on signature, payable before we start
- Remaining 50% on launch (or in agreed milestones for larger projects)
- Care plans, hosting, and retainers are billed monthly in advance
- Invoices are payable within 14 days
Late payments may attract interest at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998. We'd rather not — please just pay on time.
4. Timelines
Brochure sites typically launch in around 4 weeks, lead-gen sites in around 6 weeks, custom builds in around 8 weeks. These are estimates based on you providing what we need on time. We'll never miss a deadline without warning you first.
5. Revisions
Each design phase includes one round of revisions. Major scope changes (extra pages, new features, complete redesigns mid-project) are quoted separately so you don't get a nasty surprise at the end.
6. Ownership & intellectual property
Once your final invoice is paid, you own the work — the designs, the content we write, and the custom code we built for you. You can move it to a different host or hand it to another developer whenever you want.
We retain ownership of: our internal toolkits, frameworks, and any third-party plugins or themes (which are licensed under their own terms). We also reserve the right to feature your project in our portfolio, unless you ask us not to.
7. Hosting, care plans & support
Our hosting and care plans cover uptime monitoring, security updates, backups, and a set amount of monthly support time. Anything beyond your plan is billed at our standard hourly rate, with your approval first.
We aim for 99.9% uptime but can't guarantee an outage will never happen — the internet doesn't work that way. If a host or service we rely on goes down, we'll work to restore service as fast as possible.
8. SEO outcomes
SEO is a long game. We follow current best practice and we've ranked plenty of construction firms on page one — but Google doesn't make promises and neither do we. We can guarantee the work we do; we can't guarantee specific rankings, traffic, or lead volumes.
9. Cancellation
You can cancel a project at any time. If you cancel before launch, you'll be invoiced for work completed up to that point and the deposit is non-refundable. Care plans and retainers can be cancelled at the end of any monthly cycle with 30 days' notice.
We can cancel a project if you breach these terms, fail to pay, or behave abusively toward our team. We'll always try to resolve issues before walking away.
10. Confidentiality
Anything sensitive you share — financials, plans, login details — stays between us. We expect the same in return for any methods, pricing, or documents we share with you.
11. Liability
Our total liability under any project is limited to the fees you've paid us for that project in the 12 months before the claim. Nothing in these terms limits our liability for death, personal injury, fraud, or anything else that can't be limited under UK law.
We're not liable for indirect or consequential losses (lost profits, lost data, lost opportunities), or for issues caused by third-party services, your own staff, or anything outside our reasonable control.
12. Governing law
These terms are governed by the law of England and Wales. Any dispute falls under the exclusive jurisdiction of the courts of England and Wales. We'll always try to sort things out over a phone call first.
13. Changes
We may update these terms from time to time. The version that applies to your project is the one in force when you signed your proposal. For ongoing services we'll give 30 days' notice of any material change.
